Boston Bombing Suspect's "Forced" Confession

April 26, 2013 - update

  • Johar (Dzhokhar Tsarnaev), 19, was interrogated for 16 hours at the Beth Israel Deaconess Medical Center before being read his Miranda rights.
  • Johar allegedly confessed to the Boston bombing in writing while under duress and in critical condition.
  • Johar was not informed of his right to a lawyer, to remain silent and to not incriminate himself.
  • Johar was released from the Jewish hospital today and is still unable to speak.
  • Johar was transferred to the Federal Medical Center Devens about 40 miles west of Boston.

During 16 hours of interrogation by the FBI under duress, the 19-year-old suspect allegedly told authorities "in writing" that his older brother, Tamerlan, 26, had recently recruited him to be 'part of the attack'.  The confession included a statement that the brothers planned to explode pipe bombs in Times Square but a flaw in their plan kept them from doing it.

FBI investigators failed to advise Johar of his constitutional rights as an American citizen. FBI investigators were surprised when a magistrate judge and a representative from the U.S. Attorney's office entered the hospital room and read Johar his rights. This decision came after the White House decided against treating the suspect (who is an American citizen) as an enemy combatant. Investigators had planned to keep interrogating Johar but once he was read his rights, he stopped communicating.

It remains unclear whether Johar's forced written confession will be admissible in a criminal trial, since it came before he was read his Miranda rights. It's also unclear whether prosecutors would need the admission to secure a conviction.

Where Is The Confession?

Where is Johar's written confession that he allegedly wrote under duress? Is the handwritten confession really his or is it a fake? An independent handwriting analysis could answer that question.

According to news sources, Johar is writing the confessions on a pad of paper because of a throat injury that has silenced him.

What caused the throat injury? Reuters reported that Johar was shot through the mouth by a round that exited through his neck druing a shoot-out with police.

Contradicting that report, numerous law enforcement sources claim the throat wound was self inflicted.

Investigators are now saying there was no gun in the boat where Johar was hiding. New reports state that Johar DID NOT have a weapon on him when he was in the boat behind the house.
